Terms of Service
Terms of Service.
1. Nature of the Platform
Cover Collective provides an online platform that allows instructors and venues (“Users”) to find and connect with one another for cover arrangements. Cover Collective is not a party to any agreement between Users. It does not employ, engage, supply or act as an agent for any instructor, and it does not hire on behalf of any venue.
2. Agreements Between Users
Any cover arrangement is a direct agreement between the Users involved, whether instructor to venue or instructor to instructor. Those Users are solely responsible for agreeing its terms, including the fee, payment method, payment timing, cancellation terms, and any insurance or qualification requirements.
3. Payments
Cover Collective does not process, hold, collect, guarantee or handle any payment between Users. All fees for cover work are paid directly between the Users concerned. Cover Collective has no responsibility or liability for any payment owed, late, disputed or unpaid, and no User may seek payment of such sums from Cover Collective.
4. Disputes
Any dispute between Users, including disputes about payment, cancellation, no-shows or quality of teaching, must be resolved directly between those Users. Cover Collective has no obligation to mediate or resolve disputes, but may, at its discretion, suspend or remove accounts in line with these Terms.
5. Independent Status
Instructors using the Platform are self-employed and responsible for their own tax, National Insurance, insurance and professional qualifications. Nothing in these Terms creates an employment, worker, agency, partnership or joint venture relationship between Cover Collective and any User.
6. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, Cover Collective is not liable for any loss arising from arrangements made between Users, including unpaid fees, cancellations or the acts or omissions of any User.
If you are dissatisfied with Cover Collective, your only remedy under these Terms is to stop using it. Without limiting that, we shall have no liability for any failure or delay resulting from any matter beyond our reasonable control.
Other than as set out above, we shall not be liable in contract, tort, negligence, statutory duty, misrepresentation or otherwise for any direct or indirect loss or damage whatsoever arising from or in any way connected with these Terms or your use of Cover Collective.
Except as expressly set out in these Terms, all conditions, warranties and obligations which may be implied or incorporated into these Terms by statute, common law or otherwise, and any liabilities arising from them, are excluded to the extent permitted by law.
We shall not be liable for: (i) loss of revenue; (ii) loss of profit; (iii) loss of anticipated savings; or (iv) any other indirect, economic or consequential loss.
If any limitation or exclusion of liability in these Terms is found unenforceable, our liability to you shall not exceed £150 in aggregate in respect of all matters concerning or arising out of your use of Cover Collective.
7. Posting Fees
Separately from payments between Users (see clause 3), some actions on Cover Collective carry a posting fee payable to Cover Collective itself for use of the platform - shown before you pay. See our FAQ for current pricing.
8. Certifications and Qualifications
Instructors self-report their qualifications, certifications, and expiry dates. While we display this information and remind instructors before it lapses, it remains each instructor’s responsibility to hold accurate, valid certification, and each venue or instructor’s responsibility to satisfy themselves of the other party’s suitability before agreeing to work together.
9. Your Account
You’re responsible for the accuracy of the information on your profile. You can delete your account at any time from your account page. See our privacy policy for how we handle your data.
10. Changes to These Terms
We may update these terms from time to time. Continuing to use Cover Collective after a change means you accept the updated terms.
